I understand that as a volunteer I will not be paid for my services, and as full and final compensation for my volunteer services, I will only receive entry to the Newport Jazz Festival for confirmed volunteer days and one official Newport Jazz Festival Volunteer T-Shirt. I further understand that I will not be covered, nor have any right to make claims, under any insurance programs, including medical, property, workers’ compensation, and liability insurance maintained by NFF or any third party.

NFF has the right to end my volunteer service at any time with or without cause and also has the right to require me to leave the festival site immediately if I violate any volunteer program policies, festival rules and/or policies and/or any applicable law. I will make every effort to obey safety precautions as listed in writing and as explained to me verbally, including but not limited to, wearing closed-toe shoes, providing my own refillable water bottle, arriving to my shift healthy and sober, abstaining from alcohol/drugs while working, and only wearing my volunteer shirt during periods when I am designated to be and actually am volunteering. I will ask for clarification when needed.

I also freely acknowledge and voluntarily assume the risks involved in volunteering at an outdoor music festival on rugged state park lands at Fort Adams State Park in Newport, Rhode Island. These risks include, but are not limited to, property loss or damage and illness, physical or emotional injury, temporary or permanent, and death, including by way of potential exposure to the novel coronavirus SARS-COV-2, which causes the disease COVID-19, regardless of the Released Parties’ culpability in connection therewith. Additionally, I warrant and represent that I do not have any conditions (physical or otherwise) that might increase my likelihood of experiencing injuries, illness or death while engaging in this voluntary activity. I understand that the Released Parties do not assume any risk or liability due to my participation or attendance at the festival (including as a spectator).

By signing below, I hereby waive and forfeit all right to bring a suit or any other claim against NFF, as well as any of NFF’s affiliates, and all of their respective trustees, owners, directors, officers, employees, agents and/or representatives (collectively, the “Released Parties”) for any reason arising out of any injury or damage that I might suffer as a result of my attendance and/or participation in the festival. Such waiver and forfeit shall bind me, my heirs, successors, assigns, personal representatives and any other party claiming through me. I understand that this release benefits the heirs, personal representatives or successors and assigns of the Released Parties.

PHOTO WAIVER: I further grant permission to NFF and/or third parties authorized by NFF to create and/or use for any purpose, without further compensation to me or permission from me required, any photographs, videotapes, motion pictures, recordings or any other record created at or in connection with the festival, in which my name, image, voice or likeness appears. This Agreement shall be governed by the laws of the State of Rhode Island. Any dispute arising out of this Agreement shall be litigated in the state or federal courts situated in the City of Newport, State of Rhode Island.
